One Mission, Two Entities: ACLU of New Hampshire and ACLU Foundation of NH
To protect the enduring values of freedom and equality, the ACLU of New Hampshire uses a three-pronged approach: litigation, public education, and lobbying. In order to support all three advocacy tools and to comply with federal tax law, it is necessary to have two organizational entities. Both are nonprofit organizations but with different IRS classifications.
ACLU of New Hampshire is a 501(c)(4) nonprofit organization.
- ACLU of New Hampshire is a membership organization principally supporting our legislative lobbying work in Concord.
- Gifts to the ACLU of New Hampshire are not tax deductible, according to federal law.
ACLU Foundation of NH is a 501(c)(3) nonprofit organization.
- Gifts to the Foundation are tax deductible.
- Donations support our litigation and public education efforts.
Full funding of both organizations is vital to protecting civil liberties in New Hampshire.
Many donors choose to make their larger tax-deductible gifts to the ACLU Foundation of NH, and continue to make smaller gifts to the ACLU of New Hampshire in order to maintain their “card-carrying” membership status and to support our important lobbying efforts.

Your non-tax-deductible membership contribution benefits the work of the ACLU at the national, state, and local levels. Membership contributions to the ACLU of New Hampshire's 501(c)(4) arm allow us the flexibility we need to pursue our most pressing priorities, including legislative lobbying.

Make a gift of stock
Gifts of appreciated stocks or property are particularly advantageous from a tax point of view, especially if you own appreciated stocks on which you would have to pay long-term capital gains tax. Because each tax situation is different, please consult your tax adviser about making a gift of stock. If you have decided to give stock, the process is very simple: Ask your broker to electronically transfer the gifted securities directly to the ACLU Foundation of New Hampshire's account at Charles Schwab.
STEP 1: Notify your broker of your intention to make a tax deductible gift of stock
If your donated securities are in a Charles Schwab account send written authorization to your account executive to journal the tax-deductible gift from your account to the ACLU Foundation of NH account. Include in your authorization, ACLU Foundation of NH’s account at Charles Schwab 6498-5804 and ACLU Foundation of NH’s tax exempt ID # 02-0347237
If your securities are held by a different brokerage company, have your broker contact ACLU of NH’s Director of Philanthropy Sarah Palermo by phone at 603-227-6682 or by email at [email protected]. We will give your broker the following information:
- ACLU Foundation of NH’s account at Charles Schwab 6498-5804
- Charles Schwab DTC/BIN # 0164
- ACLU Foundation of NH’s IRS tax exempt ID # 02-0347237
STEP 2: Contact the ACLU Foundation of NH in advance of the transfer of your stock donation.
Call or email the Director of Philanthropy Sarah Palermo at 603-227-6682 or [email protected] with the following information:
- The name of the stock;
- The number of shares you are donating;
- The name and contact information of your broker; and,
- The designated purpose of your gift.
This information is necessary to identify your stock donation when the gift is received into our account at Charles Schwab. Electronic transfers of stock do not arrive with the donor’s name.
You will receive a formal acknowledgement letter for the value of your tax deductible stock gift on the day that it was sold. The value is determined by averaging the high and low for that day. Broker fees are not deducted from the full value of your gift. Please retain your letter for tax purposes.
