In May 2013, the ACLU-NH filed a lawsuit on behalf of the homeless population in Concord, New Hampshire. The lawsuit is in response to state officials’ recent efforts to clear homeless camps from public land, although the people in these camps have nowhere to go. The ACLU-NH secured a victory on May 20, 2013 by obtaining a temporary injunction barring the state from enforcing RSA 236:58, which prohibits camping on certain public property. The ACLU-NH asked the Court to turn the temporary injunction into a permanent injunction, which would prohibit the city from expelling its most at-risk individuals from public land. The Court declined to issue a permanent injunction.
